In a memorandum dated July 25, 2023, noted as QSO-23-02-ALL EXPIRED, the Centers for Medicare and Medicaid Services (CMS) provided information on a final rule regarding the expiration of COVID-19 staff vaccination requirements for all provider types, effective August 5, 2023. In addition:
- Effective June 5, 2023, surveyors will no longer assess compliance with the previous vaccination requirements for Medicare and Medicaid providers.
- CMS will not enforce the staff vaccination provisions between June 5, 2023, and August 4, 2023.
- CMS reported that most providers and suppliers demonstrated substantial compliance with the vaccination requirements when surveyed by their State.
